ChandlerApril 10, 2008, a blog called 'Intellectual Intercourse' written by Mickey Chandler (formerly with MAPS) innaccurately reported on OptOut1 Networks 'Opt Out by Domain' service as being something 'new' when, in fact, it has been in place since prior to the failed MummaGraphics spam case against prolific spammer Cruise.com. It should be noted that while Cruise.com admitted in open court that they 'never ask for permission' before emailing someone, the lower and appeals courts both found the misleading spam emails, containing forged headers, to be 'CAN-SPAM compiant'.


Let's look at the innaccuracies one by one:

OptOut1 is 'new'.

If you conisder a 3+ year old site to be 'new' then OptOut1.com is '3 years new'.

  2. Whois records show how long the domain has existed.
  3. Official press release is dated January 3, 2005.
Do people Google ANYTHING anymore before they just start yammering away on their blogs?

Comparisons to Sanford Wallace and Walt Rines

Major difference: OptOut1 does not ask for, nor store your email address, only your domain name.

Of course you'd know all this if you took two seconds to look over the OptOutByDomain.com FAQ page.

Domain is 'Done' through WebGuy.com

Were not sure what Mickey means by this. The domain is registered through PrivateDomainInfo.com which use the same 'name servers' as WebGuy domains.

Contacting senders asking them to download once a month

While no requests for monthly downloads has been made by Mr. Mark Mumma, the OptOut1 list is updated daily and new additions to the list deserve the same privacy as those list members with senority.

How else would an emailer block email to new domains that recently join OptOut1 other than doing a monthly list clean? Even with inferior list cleaning software, the entire process might take 5-10 minutes. Up to ten minutes per month to be certain of avoiding complaints from hundreds of spam hating domain owners seems like a reasonable course of action, No?

It failed then, it will fail now

As hard as it may be to believe, no. The fact that more domains are added to the OptOut1 Network as time marches on is no joke at all.

We encourage all private domain owners that want to make a statement to the courts, the spammers, the judges, the Republicans and John McCain PERSONALLY that we don't like spam and we want it to end.

Cheap or even FREE list cleaning software is not hard to find.
